It is essential that architects understand clients’ obligations to notify adjoining owners and are aware of the circumstances under which a dispute can arise. This seminar covers mainly the Party Wall Act 1996, in particular:

· What is a party wall

· Where the statute applies to building works

· How to serve valid notices

· What should be in an award

· What jurisdiction party wall surveyors have

· Why appoint a third surveyor

· Implications for designers with regard to the Act

· How to reduce risk in relation to the Act

· Other issues to consider: easements, access rights, windows on boundaries

Speaker: David Reynolds BSc(Hons) MRICS, Drivers Jonas LLP

David Reynolds has 10 years experience dealing exclusively with neighbourly matters in relation to all kinds of development from extensions to existing buildings, basement construction, residential developments, refurbishments/new build of shopping centres, warehouses and offices. Neighbourly matters include considering lighting levels for proposed residential accommodation with regard to the British Standard, analysing daylighting, sunlighting overshadowing of adjoining properties in relation to proposed development with regard to the BRE guidelines, advising on rights of light for both developers and adjoining owners, acting for building owners or adjoining owners regarding building works or as third surveyor in relation to the Party Wall Act 1996 and dealing with other issues such as scaffolding, crane trespass, means of escape over adjoining land. In 2004, David Reynolds enabled Drivers Jonas LLP to become the first ever surveying practice to join the RIBA accredited CPD Providers Network providing seminars on the Party Wall etc Act 1996 and rights of light, daylight/sunlight. David is a member of the Pyramus and Thisbe Club, a Club that seeks to advance knowledge of the Party Wall etc Act 1996 and promote best practice in its application.
